The present document (hereinafter, the “Conditions of Purchase”), as well as the rest of conditions, policies, notices and instructions mentioned in the web www.molecot.com (hereinafter the “Web”), govern the use of our Web page, the conditions of purchase of the products offered in the same one and the treatment that Molecot, S.L. makes of the personal character data. All the aforementioned documents together constitute the legal conditions of the Web (hereinafter, the “Legal Conditions”).
Therefore, please read carefully the Purchase Conditions, the Legal Notice, the Privacy Policy and the Cookies Policy, which are only available in Spanish, before using this Web.
By using this Web or placing an order through it, you (hereinafter the “User”) agree to be bound by the Legal Conditions, so if you do not agree with them, you should not use this Web.
YOUR DATA
For the purposes of Regulation 2016/679 of the European Parliament and of the Council of 27 April 2016, General Data Protection Regulation, as well as in the Organic Law 3/2018 of 5 December, on the Protection of Personal Data and guarantee of digital rights, you are informed that the data collected on this website will be included in files owned by Molecot, and will be processed for the purpose of managing and processing online and offline purchases, requests for information, placing orders and sending newsletters and own advertising.
The User shall be solely responsible for the completion of the forms on the Web with false, inaccurate, incomplete or outdated data.
Molecot, S.L. reserves the right to contact its customers and/or carry out certain checks when it deems appropriate, in order to ensure the authenticity of the personal data provided.

OUR PRODUCTS
The products we offer on the Web are porcelain pieces painted by manual and/or mechanical procedures depending on the type of product selected by the User, made to order and with exclusive designs.
The processes of elaboration of our products, design, painting, stamping, are mostly manual, so the products offered on the Web may differ in shapes, sizes, colors and drawings, which the user finally receives, not giving the right to any refund as set forth in clause 11 of these Terms of Purchase.
PRICES
The prices on the Website include VAT, but exclude shipping costs, which will be added to the final amount of the purchase, in accordance with the conditions set out in clause 9 of these Conditions of Purchase.
Prices may change at any time, but such changes will not affect orders for which we have sent a Purchase Confirmation in accordance with clause 7 of these Conditions of Purchase.
Likewise, the prices of those products made according to the User’s specifications, which differ from the models offered on the Web, will be quoted individually by Molecot, S.L. and the management of the orders will be carried out through e-mail.
Although Molecot, S.L. tries to ensure that prices are correct at all times, errors may occur. In case we detect an error in one or more products that the user has ordered, we will contact the user to provide a solution.
AVAILABILITY
The products offered through this website are only available for shipment to Spanish territory. No shipments will be made to Ceuta, Melilla and Canary Islands.
All product orders are subject to availability. If for any reason, we cannot supply the products selected in the order, we will contact the User to offer a solution. If such solution does not satisfy the User, we will proceed to reimburse the amount paid.
CONCLUSION OF THE CONTRACT
The contract is perfected when the User enters his personal data on the Web to make the purchase of the product and proceeds to the payment of the same, (hereinafter the “Contract”).
To make a purchase, you must follow the online purchase procedure and click on “FINISH PURCHASE”. After which, you will receive an email acknowledging receipt of your order (hereinafter, the “Purchase Confirmation”).
Only those products listed in the Purchase Confirmation will be subject to the Contract.
MEANS OF PAYMENT
Molecot, S.L. accepts payments:
By credit or debit card (Visa, Visa Electron, Mastercard and Maestro).
Pay Pal
Bank transfers.
To protect the security of payment by credit or debit card, we use secure payment systems. The confidential payment data is transmitted directly and in encrypted form (SSL) to the financial institution. When making the payment through the secure payment gateway, the system will automatically verify that the credit card is activated for Secure E-Commerce. Then it will connect with the issuing bank, which will request authentication and authorization of the transaction.
Through PayPal you can pay quickly and securely with your PayPal account or with your credit or debit card (no need to have a PayPal account), and without sharing financial information with Molecot, S.L.. Payments are handled entirely by PayPal, so Molecot, S.L. does not have access to your financial information.
Bank transfers will be made to the bank account number [ ], owned by Molecot, S.L. within 48 hours of receipt of the Purchase Confirmation. In the concept of such transfer must indicate the order number indicated in the Purchase Confirmation and the receipt of such bank transfer will be sent to the email address info@molecot.com.
SHIPPING AND TRANSPORTATION
Iberian Peninsula Orders
Without prejudice to the provisions of Clause 6 of these Conditions of Purchase, the shipment of the products object of the Contract, will be carried out within a maximum period of 5 calendar days from receipt of the Purchase Confirmation.
However, if we receive your order by 2pm, we aim to dispatch your order same day. If your order is received after 2pm, it will be dispatched the following day. However, this cannot always be guaranteed.
Please note that no orders are dispatched during the weekend.
In the case of personalized products, the aforementioned period may be extended, if Molecot, S.L. deems it appropriate, upon written notice to the User, who, if not satisfied with the extension of the deadline, may withdraw from the purchase within 48 hours after receiving the email informing him of the extension of the deadline.
Iberian Peninsula Delivery
The transport costs, within the Iberian Peninsula, will be free for purchases with a final amount, established in the Purchase Confirmation, equal or superior to 150€.
For orders under 150€, according to the final amount stated in the Purchase Confirmation, and shipments outside the Iberian Peninsula, the shipping costs will be paid in full by the User. Said transport costs will be 14,90€, being able to increase said amount, if the contracted transport company so determines.
International Orders

Customs
When a package is delivered internationally, it may be subject to duties, taxes, customs duties, and / or handling fees by the destination country. These charges are typically due once the package arrives in the destination country. The customer is responsible for paying these charges, which may be done through your local customs office. If left unpaid, or if a customer rejects their item at customs, the shipping cost to return that item to Molecot, will be deducted from the original product price customer refund.
International Delivery
Please note that if you are purchasing from outside of SPAIN, you may be charged an import tax. This is the customer’s responsibility to pay.

TRANSFER OF RISK AND OWNERSHIP OF THE PRODUCTS
The User shall acquire ownership of the products at the time of delivery, so that the risks of the products shall be borne by the User from the time of delivery.
RETURNS AND EXCHANGES
If you are not entirely satisfied with your purchase, we’re here to help.
Our products are designed and painted according to the specifications of the User, and therefore they are customized products, so that in accordance with Article 103 of Law 3/2014, of March 27, amending the revised text of the General Law for the Defense of Consumers and Users and other complementary laws, approved by Royal Legislative Decree 1/2007, of November 16, the right of withdrawal does not apply.
In the unfortunate case that your item(s) are damaged or broken in transit, please notify us within 5 days of receiving it at orders@molecot.com, attaching a photo to the email, a brief description of the damage, the order number and shipping information. We understand how disappointing this can be and will do our absolute best to replace them as quickly as possible. Once we receive your email, we will follow-up with next steps. Please note, however, any faults reported after 5 days of receiving the item, will be deemed as general wear and tear.
For international orders, if an item is returned because a customer refused to pay for any import taxes or customs duties due payable, Molecot will seek to recover from the customer all costs or any fees incurred by Molecot. Please note that if you refuse to pay custom duties upon delivery, a refund will only be issued after the product has been returned to us.
Please allow up to 4-7 business days for refunds to be processed once your return has been received by our warehouse.

COMMUNICATIONS
Any suggestion, doubt, complaint or claim that the User may have regarding the Legal Conditions of the Web, or in general, about the execution of this Contract, should send an email to the following address info@molecot.com .
Likewise, and in accordance with the provisions of clause 3 above and unless otherwise stipulated in accordance with the rights of the User, we may send communications either by email or by post to the address provided by the User when placing an order. FULL SETTLEMENT AND PARTIAL NULLITY
The present Conditions of Purchase, as well as the rest of the conditions, policies, notices and instructions mentioned in the web, the Legal Conditions, constitute the entire agreement existing between the User and Molecot, S.L. in relation to the object of the same and replace any other pact, agreement or previous promise agreed between the User and Molecot, S.L. verbally or in writing.
If any provision or provisions of these Conditions of Purchase or the Legal Conditions were declared null and void by a final decision issued by a competent authority, the remaining terms and conditions of the Legal Conditions shall remain in force, without being affected by such declaration of nullity.
ASSIGNMENT OF RIGHTS AND OBLIGATIONS
The contract is binding both for the User and for Molecot, S.L. as well as for our respective successors, assigns and assignees.
The User may not transfer, assign, encumber or otherwise transfer a contract or any of the rights or obligations arising therefrom, without obtaining the prior written consent of Molecot, S.L..
Molecot, S.L. may transfer, assign, encumber, subcontract or otherwise transfer a contract or any of the rights or obligations arising therefrom, at any time during its term. For the avoidance of doubt, such transmissions, assignments, encumbrances or other transfers shall not affect the rights that, if any, the User, as a consumer, has recognized by law or cancel, reduce or limit in any other way the guarantees, both express and implied, that Molecot, S.L. could have granted to the User.
TAXES AND INVOICING
In accordance with the provisions of Article 68 of Law 37/1992 of 28 December 1992 on Value Added Tax, the supply of the products shall be understood to be located in the territory where Spanish VAT is applicable.
The applicable VAT rate will be the one legally in force at any given time depending on the specific product in question.
The User expressly authorizes to issue the invoice in electronic format. However, he/she may indicate to Molecot, S.L. at any time his/her wish to receive an invoice in paper format, in which case, we will issue and send the invoice in this format by post.
MODIFICATION OF CONDITIONS

APPLICABLE LAW AND JURISDICTION
The use of the Web and the Contracts made through the Web shall be governed by the Spanish legislation.
Molecot, S.L. and the User, expressly waiving any other jurisdiction, submit to the courts and tribunals of the User’s domicile for any dispute that may arise from access, use and contracting through this Web.
However, in the event that the User is domiciled outside Spain, Molecot, S.L. and the User submit, expressly waiving any other jurisdiction, to the courts and tribunals of the city of Madrid (Spain).
